Island works

Palm Bungalow works: April 2024 - December 2024 - To ensure the continued upkeep of the island, construction works have been scheduled from 15 April to 20 December 2024. Some of these works are in proximity to the Palm Bungalows and as a result there may be some noise on weekdays from 7:00 AM to 5:00 PM, and occasionally on Saturdays. The works have been planned and scheduled to minimize inconvenience to our valued guests.

Booking Credit Card Transaction Fees

Holiday Home bookings made via the Hamilton Island website or call centre incur a non-refundable 1.25% surcharge for Visa, MasterCard, Union Pay, JCB and AMEX credit and debit cards. Credit/debit card transaction fees are non-refundable.

On Island Credit/Debit Card Transaction Fees

A non-refundable 1.25% surcharge applies for all ‘credit’ and ‘tap and go’ transactions made on the island via credit or debit card. Payments can be made fee free via EFTPOS by inserting your card and selecting a cheque and/or savings account at the terminal.

1. Definitions:

In the Terms and Conditions:

Activate means the initial loading of value onto a Hamilton Island Gift Card.

Card Balance means the unspent value of a Hamilton Island Gift Card.

Card Number means 22-digit number that appears on the back of a Hamilton Island Gift Card.

eGift Card means an electronic stored value gift card issued by Hamilton Island Enterprises Limited.

Hamilton Island means Hamilton Island, located in the Great Barrier Marine Park. Reference to Hamilton Island includes Dent Island.

Hamilton Island Enterprises Limited or HIE means Hamilton Island Enterprises Limited ACN 009 946 909, 3/100 Pacific Highway, St Leonards NSW 2065.

Hamilton Island Gift Card or Gift Card means a physical card or an electronic version that can be exchanged for a specified cash value of goods and services provided by HIE.

Expiry Date means the date, being stated on the reverse of the Gift Card, after which any remaining funds on a Hamilton Island Gift Card will not be available for redemption. Gift Cards have a 36-month expiry date after the date of purchase. For eGift Cards the expiry date is stated in your confirmation email which encloses your digital card.

PIN means the 4-digit access number printed on the reverse of a Physical Hamilton Island Gift Card or as stated on eGift card confirmation email.

Participating Outlets means all outlet on Hamilton Island owned and operated by HIE as detailed at https://www.hamiltonisland.com.au/complimentary-gift-cards/participating-outlets.

Physical Gift Card means a physical card with a stored monetary value issued by HIE.

Redeem means to reduce the value loaded on your Hamilton Island Gift Card by using the Hamilton Island Gift Card to purchase goods or services provided by HIE on Hamilton Island.

Website means giftcards.hamiltonisland.com.au or giftcards.qualia.com.au.

A reference to "we", "us", or "our" is a reference to Hamilton Island Enterprises Limited
A reference to "you" or "your" is a reference to the person who is taken to agree to these terms and conditions under clause 2.

2. Agreement to the terms and conditions

2.1. These terms and conditions apply to all Hamilton Island Gift Cards.

2.2. You agree to be bound by these terms when using, or attempting to use a Hamilton Island Gift Card or by making a transaction enquiry or exercising any right to redeem value loaded on a Hamilton Island Gift Card.

2.3. By using or attempting to use a Hamilton Island Gift Card, or by making a transaction enquiry or exercising any right to redeem value loaded on a Hamilton Island Gift Card, you warrant that you will comply with these terms and conditions and all applicable laws and that the Hamilton Island Gift Card will not be used in any manner that is unlawful, misleading, deceptive, unfair or otherwise harmful to consumers.

3. Redeeming your Hamilton Island Gift Card

3.1. Hamilton Island Gift Cards and Hamilton Island eGift Cards can be redeemed for goods and services at Participating Outlets. The redeemed value is deducted from the Card Balance. Please see our FAQ at https://www.hamiltonisland.com.au/complimentary-gift-cards/faqs for common questions and queries regarding our gift card program.

3.2. When redeeming a Gift Card for our goods and services on Hamilton Island, Gift Card holders must be over the age of 18 years. Proof of age must be provided, if requested, with an officially recognised photographic identification document. If proof of age cannot be verified, we reserve the right to refuse redemption of the Gift Card until appropriate proof of age can be provided showing the Gift Card holder is over the age of 18 years.

3.3. Photographs of Gift Cards will not be accepted for redemption. Physical Gift Cards must be present at redemption, or a version converted into an approved digital wallet app on a smartphone.

3.4. When redeeming a Gift Card, tips or gratuities may be included within the amount charged to the Gift Card, at the user’s discretion.

3.5. Resale of Hamilton Island Gift Cards is strictly prohibited, except with prior written consent from us. If approved, Gift Cards cannot be re-sold for more than the original purchase price.

3.6. Your use of the Hamilton Island Gift Cards at a Hamilton Island outlet is subject to our policies (and, where applicable, other terms and conditions) regarding the goods and services made available by us.

3.7. Where the price of the goods or services being purchased with the Hamilton Island Gift Card exceeds the Card Balance, you must pay the amount exceeding the Gift Card Balance by an alternative payment method.

3.8. Once your Hamilton Island Gift Card has reached a nil balance it cannot be re-activated.

3.9. By redeeming your Hamilton Island Gift Card, you agree that you must not engage in any conduct which is fraudulent or may be contrary to the intention of the Hamilton Island Gift Card program, including but not limited to:

a. the on-selling of goods to a third party for a profit or other commercial purpose, where those goods have been purchased through the use of a Hamilton Island Gift Card;

b. the on-selling of Hamilton Island Gift Cards to a third party for an additional mark up, regardless of whether those Gift Cards were purchased by you at full price or for a discount;

c. use the Hamilton Island Gift Card to fraudulently earn reward or loyalty points through an affiliate marketing program, with the intention to gain points, profit, or other benefit.

We do not accept any liability for Gifts Cards that may have been on sold.

3.10. If we consider that you have engaged in any of the above conduct, we may enforce our rights under clause 10, upon written notice to you.

3.11. We reserve the right to cap Gift Cards per redemption in store to a maximum of 5 Gift Cards.

4. Balance enquiries

4.1. The Card Balance is printed on the register receipt each time you use your Hamilton Island Gift Card. You can also check your Hamilton Island Gift Card balance at any point of sale on request or at giftcards.hamiltonisland.com.au. No change is given and any balance that remains on the card can only be used in whole or part against future purchases for Hamilton Island goods and services. The expiry date of Gift Cards is printed on the reverse of the Physical Gift Card the confirmation email for eGift cards and Google or Apple Wallet if uploaded. Any balance that remains on the card after the expiry date will not be available for use.

5. Lost or Stolen Hamilton Island Gift Cards

5.1. You must treat your Hamilton Island Gift Card like cash or money. Hamilton Island Gift Cards cannot be refunded, returned or exchanged for cash as we have no obligation to replace or refund the value of the Hamilton Island Gift Cards, including for (but not limited to) lost or stolen Hamilton Island Gift Cards, except where we have breached any condition or warranty implied under consumer protection legislation that cannot be excluded in these terms and conditions.

5.2. We reserve the right to place a stop on your Hamilton Island Gift Card if:

a. You report that your Hamilton Island Gift Card has been lost or stolen; or

b. We believe (or reasonably suspect) that you have used your Hamilton Island Gift Card (or will use) contrary to these Terms and Conditions.

6. Liability

6.1. You are responsible for your Hamilton Island Gift Card, and are liable for all transactions made using your Hamilton Island Gift Card.

7. Penalties

7.1. A breach of these Terms and Conditions may result in any of the following consequences, including but not limited to:

a. immediate deactivation of any Hamilton Island Gift Cards which have been purchased by you but not yet been redeemed;

b. immediate forfeiture of any outstanding balance on the Hamilton Island Gift Cards; or

7.2. Without limitation, a contravention of clause 3.9 will be deemed a breach of these terms and conditions.

8. Relationship with Hamilton Island Enterprises Limited

8.1. Hamilton Island Gift Cards may be used as personal or business gifts but must not be used in connection with any marketing, advertising, or other promotional activities (including without limitation in websites, internet advertisements, email, telemarketing, direct mail, newspaper and magazine advertisements, and radio and television broadcasts) unless you obtain our prior written approval from Hamilton Island Enterprises Limited.

8.2. Use of our name or brands, or any names and logos of Hamilton Island (other than in connection with the purchase or use of Hamilton Island Gift Cards), and the use of any imagery provided by us is strictly prohibited without prior consent from us.

8.3. For any approval requests for marketing, advertisements, or other promotional activities please contact Hamilton Island via email at marketingrequest@hamiltonisland.com.au (9:00AM – 5:00PM, Monday to Friday AEST).

9. Privacy Collection Notice

9.1. This Notice explains how we and our affiliates manage your personal information and complaints. More information can be found at https://www.hamiltonisland.com.au/privacy-policy.

9.2. Upon purchasing a Gift Card, we collect purchasers’ personal information directly from purchasers wherever practicable. We may collect personal information from our related companies or other third parties.

9.3. We will use your personal information primarily to provide Gift Cards, confirm and maintain Gift Card, and provide information about the products and services you have requested offered by us. If you do not provide us with that information, we may be unable to process your Gift Card purchase.

9.4. We may disclose your personal information, including updates, to agents or contractors acting on our behalf and regulatory authorities where required by law. We will also use this information for research to improve our products and services.

9.5. Our Privacy Policy sets out how you can access and make a request to correct your personal information we may hold about you, or to make a privacy complaint, and how we will deal with the complaint. 10. General

10.1. Gift Cards are a form of tender to make purchases at any HIE Participating Outlet.

10.3. The purchasing and redeeming of Gift Cards are subject to the laws of Queensland and any dispute arising under these Terms and Conditions or otherwise in respect of the Gift Cards will be submitted to and determined by the exclusive jurisdiction of the courts of Queensland.

10.4. Nothing in these Terms and Conditions limits, excludes, or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under any similar consumer protection laws in the State and Territories of Australia.

10.5. If you wish to dispute an amount deducted from your Hamilton Island Gift Card, you must contact Hamilton Island Head Office via email giftcards@hamiltonisland.com.au. If an amount is not disputed within thirty (30) days after the transaction date, we may at our sole discretion refuse to provide you with a refund.

10.6. We encourage consumers to consume alcohol in moderation. Legal aged consumers are advised to consider the ‘low risk drinking’ guidelines recommended in the National Health & Medical Research Council Australian Alcohol Guidelines at http://www.nhmrc.gov.au/_files_nhmrc/file/publications/synopses/ds10-alcohol.pdf. Consumers are also encouraged to visit the Australian Government’s information site for alcohol at www.alcohol.gov.au.

Standard Deposit(excludes Festive Season)

A deposit equivalent to 20% of the total booking value is required at time of booking
This deposit is refundable up until 28 days prior to arrival date

The final balance payment of your accommodation is required no later than 21 days prior to arrival date

Standard Cancellation and Amendments(excludes Festive Season)

Notice of any cancellation, amendment or reduction in reserved Hamilton Island Holiday Home stay must be provided in writing to Hamilton Island Holidays on vacations@hamiltonisland.com.au
Cancellations and amendments received outside 29 days or more before the arrival date will not incur a cancellation fee
Cancellations and amendments received within 22-28 days of arrival date will be subject to a cancellation fee of 20% of the total booking value
Cancellations and amendments received within 21 days of arrival date, ‘No Shows’ and/or ‘Early Departures’ will be subject to a cancellation fee of 100% of the total booking value
If you have booked through a travel agent or Online Travel Agent, please contact them directly to make changes to your booking
Credit/debit card transaction fees apply and are non-refundable
Change and cancellation fees are not payable where you are entitled to a refund under the Australian Consumer Law.

Holiday Homes General Terms

Please read these terms and conditions carefully.
All bookings made with Hamilton Island Holidays are subject to these terms and conditions and by making a booking (paying your deposit) you are accepting these Terms and Conditions on behalf of yourself and all persons who will be staying in the accommodation.
Hamilton Island Property Sales Pty Ltd is the agent appointed by third party private property owners to manage the holiday homes. While the agent uses its reasonable endeavours to manage the property on behalf of the owner, ultimately the owner is responsible for the condition of the property, including but not limited to all furniture and fittings.
Bookings may be subject to additional terms and conditions which are specific to unique packages. Every now and then a variation to these may be applicable to special packages or offers.booked. These terms and conditions may relate to items such as payments, deposits and cancellations and you should confirm the exact conditions before booking.
Once you have made your booking, make sure to check the Room or Package inclusions on your Booking Confirmation email to be certain of the specific details that apply to your unique booking.
Hamilton Island reserves the right to modify or supplement at any time all or part of these Terms and Conditions. In this case a new version of the General Terms and Conditions will be available on the site with the effective date. Guests are advised to regularly consult the General Terms and Conditions to be aware of any changes.

Entertaining in a Hamilton Island Holiday Home
The premises are let to you for holiday purposes only for the period stated on the receipt. No weddings, parties, large gatherings, commercial activities, or functions including professional photo shoots are allowed unless arrangements and permission have been granted by Hamilton Island Holiday Homes on behalf of the property owner. If these Terms and Conditions are breached penalties and fees will apply. To enquire about hosting an event or gathering in one of Hamilton Island's event space, please contact our events team here.

Hamilton Island minimum age requirement
All persons under the age of 18 must be accompanied by a responsible adult such as a parent, step-parent, guardian who has parental rights and responsibilities for the under 18 year old person. If a person is found to be under the age of 18 and is not accompanied by a responsible adult, Hamilton Island Enterprises Limited (HIE) may cancel the person’s booking and ask them to leave the island immediately, with the full booking amount being forfeited to HIE under this condition.

Arrival details
For any persons arriving to stay overnight on Hamilton Island, we need your Arrival Details as soon as you have them so that we can do our best to have your Holiday Home ready on time. We will email you closer to your holiday to obtain these details or you can email us on vacations@hamiltonisland.com.au.

Check-in / Check-out
Check-in is 2.00pm. Check-out is 10.00am.
We recommend you pack a change of clothes, swimmers, book, sunscreen and sunglasses in your hand luggage so that you can enjoy some pool or beach-time while you wait for your Holiday Home to be ready.

Online Holiday Home booking requests
If you submit a booking request via our website (hamiltonislandholidayhomes.com.au) and the Holiday Home is available, the credit card provided at the time of booking will be processed for the nominated value and you will receive a formal confirmation email outlining your reservation details.
Should your requested Holiday Home not be available you will be contacted by our Hamilton Island Reservations team to discuss alternatives. We encourage you not to book flights until you have received a formal booking confirmation email from our Reservations team.

Map images, if shown, are for general information and may not necessarily reflect actual routings, locations or services provided.
Destination shots may have been supplied to HIE by third parties and HIE does not guarantee the accuracy of any destination shots.

Flight bookings with Hamilton Island Holidays
If your flights have been booked and paid for directly with the Hamilton Island Holidays, your flight itinerary and e-tickets will be attached to your first confirmation email. It is important that you check your flight itinerary details and spelling of all passenger names as soon as you receive your e-tickets. If any information is incorrect please email us as soon as possible on flights@hamiltonisland.com.au..

Flight e-tickets
Please print your e-tickets and put them in a safe place, ready to take with you to the airport. You may be required to present this document upon check-in and airport security checks. Should you misplace your tickets, please email flights@hamiltonisland.com.au and request new copies.

Flight cancellations and changes
Flights purchased are subject to the terms and conditions of the airline, including applicable fees and surcharges for any amendments or cancellations. If you need to make any changes to your flights, please email us as soon as possible on flights@hamiltonisland.com.au.

If you have booked flights directly with the airline you will need to contact them for any amendments or cancellations.

Virgin Australia Velocity Points
Stays in Yacht Club Villas and Hamilton Island Holiday Homes are excluded from earning Velocity Points.

Third party promotions and prizing
Hamilton Island room nights cannot be purchased for the purpose of third party promotions and prizing.

Promotional Misprints
Hamilton Island Enterprises Limited (HIE) endeavours to ensure that all prices listed on their website are accurate and up-to-date. If we discover an error in the price of any offer you have booked, we will inform you as soon as possible and give you the option of cancelling it, or reconfirming the booking at the correct price (in the case of a price error). If we are unable to contact you, the booking will be treated as cancelled and if you have already paid you will receive a full refund.

Kids Eat free is only available when a minimum of one main adults’ meal is ordered.

Buggies
These are the general terms and conditions for buggies:

All nominated drivers must present a valid driver licence and undergo a safety demonstration prior to rental
All details and photos must be clear and legible for the licence to be considered valid
A credit card must be provided as security against damage and other charges
The maximum payload for a golf buggy is 364kg
The maximum persons on a buggy is 4 people
All occupants of the buggy must be wearing their individual seatbelt at all times
Only licenced drivers nominated on the rental agreement are permitted to operate the golf buggy
Any cost incurred as a result of damages to the buggy, persons, or property is the responsibility of the hirer
Ignition key must be removed when the buggy is not in use. Replacement charge for a key can cost up to $300
Queensland Road Rules apply and are enforced by QLD police and Island Safety when driving on Hamilton Island
All accidents or incidents must be reported immediately to Island Safety by calling 07 4946 9999, available 24/7
Open alcohol is not permitted on the buggy at any time
Do not use mobile phones while driving the buggy
Children are not permitted to drive, steer, or sit on the drivers lap. Children are not to touch, stand or play with operating pedals
Buggies must not be operated in neutral gear
Management reserves the right to refuse rental or confiscate a buggy in the interest of public safety
Buggies are not permitted to be operated between the hours of 1.00am & 5.30am
Please be aware that as a condition of use, a $0 hold will be placed on your credit card when collecting your buggy.
You have the option to purchase a $12 per day damage waiver to protect against accidental damage. If the buggy is damaged and the waiver has not been purchased then $1,500 is charged to your credit card until the damage and cost has been assessed.
Queensland Department of Transport and Main Roads have set out the following condition for use for all buggies operating on Hamilton Island:
- Authorised drivers must be a minimum age of 21 years old and hold a current driver’s licence to drive the vehicle.
- A passenger less than six months old must be restrained in a rearward facing infant restraint, located in the front seat and secured to an engineered anchor point and fitted seatbelt.
- A passenger at least six months old, but less than four years old must be restrained in an approved forward facing child restraint and secured to an engineered anchor point and fitted seat belt. This is subject to the amount of engineer approved restraint mounting points the buggy comes equipped with.
- Children are not permitted to travel on the lap of another passenger.
- A passenger at least four years old, but less than seven years old must be restrained in an approved forward facing child restraint or by a seatbelt.
- A passenger four years old and above must not occupy the front passenger seating position if there is another passenger who is less than four years old.
- The seats will be fitted by trained staff and should remain secured to the buggy for the duration of the rental. Securing and adjustment of straps in the capsule to fit the child is the responsibility of the parent or guardian (hirer).
- The hirer is responsible to recheck capsule anchorage points and adjust the straps securing the capsule to the seat each time the child is placed in the capsule restraint. Capsule covers cannot be used when the child is positioned in the capsule

Travel Insurance
We recommend purchasing travel insurance to cover cancellations, travel delays and other unforeseen incidents and accidents. We encourage you to read the insurance terms and conditions to ensure you’re covered for your planned travel.

Property Removed from Letting Pool
All homes in the Hamilton Island Holiday Homes letting pool are privately owned as such an owner may decide to remove the property from the letting pool.
In the event that the property you have selected is removed from the Letting Pool, you will be notified and we will endeavour to offer you a suitable alternative. Should an alternative holiday property option not be suitable for the period of your stay, you may cancel the accommodation booking without penalty.

Mid-stay cleans
Only Yacht Club Villa stays of five (5) nights or more receive a complimentary mid-stay clean. For shorter stays and non-Yacht Club Villa properties, your Holiday Home is not serviced during your stay. Is your booking directly with us or with a third party? (it is important to understand the difference)
You can book directly with Hamilton Island Travel Pty Ltd ACN 010305781 (Hamilton Island Holidays) which is a wholly owned subsidiary of Hamilton Island Enterprises Limited (HIE) via our websites or directly with our Reservations Team or you can book with a third party travel agent like Flight Centre, booking.com, expedia etc. These are the general terms that apply to HIE owned Hotels and privately managed properties in the Hamilton Island Holiday Homes letting pool. If you have booked via a third party you must check their terms and conditions for specific inclusions and conditions relating to your booking.

All bookings made are subject to these terms and conditions and by making a booking (paying your deposit) you are accepting these Terms and Conditions on behalf of yourself and all persons who will be staying in the accommodation.
Bookings may be subject to additional terms and conditions which are specific to unique packages. Every now and then a variation to these may be applicable to special packages or offers.booked. These terms and conditions may relate to items such as payments, deposits and cancellations and you should confirm the exact conditions before booking.
Once you have made your booking, make sure to check the Room or Package inclusions on your Booking Confirmation email to be certain of the specific details that apply to your unique booking.
Hamilton Island reserves the right to modify or supplement at any time all or part of these Terms and Conditions. In this case a new version of the General Terms and Conditions will be available on the site with the effective date. Guests are advised to regularly consult the General Terms and Conditions to be aware of any changes.

Arrival details
For any persons arriving to stay overnight on Hamilton Island, we need your Arrival Details as soon as you have them so that we can do our best to have your room ready on time. We will email you closer to your holiday to obtain these details or you can email us on vacations@hamiltonisland.com.au.

If you have booked flights directly with the airline you will need to contact them for any amendments or cancellations.

Regional Local Packages
For guests who have booked regional rates prior to 3 June 2024:

If your booking is for two or more adults, all adult ferry transfers are included in the total package rate (ie. extra charges for the additional adult ferry transfers are included in your total per person package price)
If your booking is for one adult and one child, the ferry transfer for one child is included as part of your package
If your booking is for one adult and two children, you will be required to purchase an additional ferry transfer for the second child (or any additional children). Children 12 years and under stay and eat free on Hamilton Island, however Cruise Whitsundays operates privately and therefore only two ferry tickets are included in this package

Third party promotions and prizing
Hamilton Island room nights cannot be purchased for the purpose of third party promotions and prizing.

Security Deposits

You must provide a credit card for pre-authorisation or imprint when you check-in.
This authorisation may be used to cover incidental items including but not limited to telephone charges, security bond or deposit for any breakages or damage incurred during your stay or cleaning charges in excess of the normal level of cleaning.
The pre-authorisation process validates your credit card, and protects both the cardholder and merchant from increasing fraud incidents.
The pre-authorised amount is set aside by the card issuer for a period of up to 14 days from the date of pre-authorisation and the pre-authorisation will affect your available funds balance or spending limit. For more information on this practice please contact your card issuer.
Once a pre-authorisation has been made, HIE cannot release, remove or lower the authorised amount, until we process the final account on departure. This is a restriction imposed by the card issuer, and cannot be negotiated.
Where a credit card is not available a minimum $200.00 cash deposit will be required on check-in. (The actual amount required may be higher at some Participating Properties)

Third Party Products and Services

Third party products or services, eg. airfares, are sometimes sold together with accommodation provided by HIE. In such circumstances the third party is entirely responsible for supplying the products or services to you and any involvement HIE has in facilitating your booking with the third party is as the third party's agent. HIE is in no way the supplier of the products and services and to the extent permitted by law HIE is not liable for any failure by the third party to provide the products or services, nor for any act, error, omission, default or negligence of the third party
All third party coupons, vouchers, receipts and tickets are issued subject to the terms and conditions specified by those third parties
HIE does not warrant the accuracy of any information, statements or representations made by third parties.

Release, indemnity and proportionate liability

To the extent permitted by the law, you agree to release, indemnify and hold harmless, HIE and its current and former officers, employees, contractors, sub-contractors/consultants (including their respective employees and contractors) and agents against, from and in respect of all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including but not limited to consequential and economic losses, property loss/damage and damages for injury, including personal injury and death) arising out of, caused by, attributable to or resulting from your booking or your stay at the relevant Participating Property except to the extent such expense, cost, liability, claim, action, proceeding, damage, judgement or loss arose out of, was caused by, attributable to or resulted from HIE's negligence, wrongful act/omission or breach of these terms and conditions.
To the extent permitted by law the aggregate of HIE's liability to you is limited to an amount not exceeding the amount paid by you for your booking.
Each indemnity in these terms and conditions is a continuing and independent obligation and survives the termination or expiry of these terms and conditions.

Consumer Law

To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied or conferred by statute, custom or the general law that impose any liability or obligation on HIE are excluded under these Terms and Conditions
Nothing contained in these Terms and Conditions excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or under any international consumer protection legislation, provided that, to the extent that such law permits HIE to limit its liability, then HIE's liability is limited to:
In the case of services, supplying the services again or payment of the cost of having the services supplied again; and
In the case of goods, replacing the goods, supplying equivalent goods or having the goods repaired, or payment of the cost of replacing the goods.

Events Beyond Control

HIE is not responsible for any loss arising out of any occurrences or conditions beyond its control, including but not limited to acts of terrorism, act of God, defects in vehicles, war, strikes, theft, delay, cancellation, civil disorder, disaster, Government regulations or changes in itinerary or schedule
All travel documents, observance of laws and government regulations are your responsibility.

Use of Information

You consent and authorise HIE to collect, use and disclose your personal information for the purposes of administering your booking and providing you with any services associated with your booking
You consent to information which you have provided to HIE as part of your booking being used by HIE, any of their related bodies corporate for the purpose of informing you about offers and promotions which relate HIE, HIE's related bodies corporate
HIE will not provide or disclose any information you have provided to HIE or the relevant Participating Property to any person other than a related body corporate without your prior written consent
Upon request by you and to the extent permitted or required by law, HIE will provide you with access to and/or the ability to correct your personal information however only the person who made the booking will be entitled to access and/or correct personal information pertaining to that booking

General

The Terms and Conditions are governed by and will be construed in accordance with the laws of the State of Queensland, Australia
If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
